Agreement to Terms

By accessing or using Transcrecia's German transcription services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

Definitions

"Service" or "Services"

Refers to the German transcription, language correction, editing, and quality assurance services provided by Transcrecia.

"Content"

Refers to audio files, video files, text documents, and any other materials submitted by users for processing.

"Transcript"

The written output generated from processing user Content through our Services.

"User", "You", "Your"

Refers to the individual or entity accessing or using our Services.

"Transcrecia", "We", "Us", "Our"

Refers to Transcrecia and its operators.

Services Description

Transcrecia provides professional German language services including:

• German transcription of audio and video content
• Language correction and editing services
• Quality assurance for transcripts and documents
• Related language consulting services

We offer both AI-powered and human transcription services, with varying levels of accuracy, turnaround times, and pricing as detailed on our pricing pages.

User Accounts and Registration

Account Creation

To access certain features of our Services, you may be required to register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Notify us immediately of any unauthorized use of your account
• Take responsibility for all activities that occur under your account

Account Termination

We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms of Service.

Service Usage and Restrictions

Permitted Use

You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to use our Services:

• In any way that violates any applicable federal, state, local, or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material
• To impersonate or attempt to impersonate Transcrecia, a Transcrecia employee, another user, or any other person or entity
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services

Prohibited Content

You agree not to submit any Content that:

• Contains illegal material or promotes illegal activities
• Infringes upon any third party's intellectual property rights
• Contains malicious code, viruses, or other harmful components
• Is defamatory, obscene, pornographic, or offensive
• Violates any person's privacy rights

Payment Terms

Pricing and Fees

Our current pricing for Services is available on our pricing pages. We reserve the right to change our prices at any time, but will provide notice of price changes to existing customers.

Billing

Payment is due upon submission of Content for processing. We accept various payment methods as indicated on our website. You agree to provide current, complete, and accurate purchase and account information for all purchases.

Refunds

Refund requests are considered on a case-by-case basis. Generally:

• If we are unable to process your Content due to technical issues on our end, a full refund will be provided
• If you are dissatisfied with the quality of our Service, please contact us first to resolve the issue
• No refunds are provided for completed services unless there is a clear error on our part

Intellectual Property Rights

Your Content

You retain all ownership rights to the Content you submit to us. By submitting Content, you grant us a limited license to use, reproduce, and modify the Content solely for the purpose of providing the Services to you.

Our Intellectual Property

The Services and their original content, features, and functionality are owned by Transcrecia and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Transcript Ownership

Upon full payment, you own the resulting Transcript. We assign all rights, title, and interest in the Transcript to you, except for any pre-existing intellectual property owned by us.

Confidentiality and Data Protection

We take the confidentiality of your Content seriously. We implement appropriate technical and organizational measures to protect your data in accordance with our Privacy Policy.

Confidential Information

We treat all Content submitted for processing as confidential. Our staff and contractors are bound by confidentiality agreements.

Data Processing

Service Level Agreements

Turnaround Times

Estimated turnaround times are provided for each service type. While we strive to meet these estimates, they are not guarantees. Factors such as audio quality, content complexity, and volume may affect actual turnaround times.

Accuracy

We provide accuracy estimates for our Services based on typical conditions. Actual accuracy may vary depending on audio quality, speaker clarity, background noise, and technical terminology.

Availability

We strive to maintain high service availability but do not guarantee that the Services will be available uninterrupted or error-free.

Limitation of Liability

To the fullest extent permitted by applicable law, Transcrecia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall Transcrecia's total liability to you for all damages exceed the amount of fifty dollars (€50) or the amount you paid Transcrecia in the last six months, whichever is greater.

Indemnification

You agree to defend, indemnify, and hold harmless Transcrecia and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) resulting from or arising out of:

• Your use and access of the Services
• Your violation of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any Content that you submit to the Services

Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Bosnia and Herzegovina, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
